การอ้างอิงถึงคำว่า "เว็บไซต์" หมายความรวมถึงแต่ไม่จำกัดเพียงสารสนเทศ ข้อมูล รายงาน ข้อความ ภาพ การเชื่อมโยง เสียง ภาพกราฟฟิค และภาพวีดิทัศน์ที่แสดงในเว็บไซต์นี้ และการอ้างอิงถึงคำว่า "บริการทางอิเล็กทรอนิกส์" หมายถึง บริการทางอิเล็กทรอนิกส์ที่มีใน หรือที่เกี่ยวข้องกับเว็บไซต์นี้ เมื่อท่านได้เข้ามาในเว็บไซต์นี้ และ/หรือใช้บริการทางอิเล็กทรอนิกส์ ท่านตกลงที่จะผูกพันตนตามข้อกำหนด และเงื่อนไข ดังต่อไปนี้ หากท่านไม่ยอมรับข้อกำหนด และเงื่อนไขใด ขอให้ท่านออกจากเว็บไซต์นี้ และ/หรือยุติการใช้บริการทางอิเล็กทรอนิกส์ โดยทันที

บริษัทหลักทรัพย์ดีบีเอส วิคเคอร์ส (ประเทศไทย) จำกัด ("ดีบีเอส วิคเคอร์ส") และ/หรือบริษัทแม่ของ ดีบีเอส วิคเคอร์ส และ/หรือบริษัทย่อย และบริษัทที่เกี่ยวข้องกันของดีบีเอส วิคเคอร์ส (ซึ่งจะเรียกรวมกันว่า "กลุ่มบริษัทดีบีเอส") ได้จัดทำเว็บไซต์ บริการทางอิเล็กทรอนิกส์ และเนื้อหาในเว็บไซต์บนหลักการ "ตามที่เป็นอยู่" และ "ตามที่มีอยู่" ในขณะนั้น ทั้งนี้ สมาชิกในกลุ่มบริษัทดีบีเอส กรรมการ พนักงาน ตัวแทน บริษัทร่วม และบริษัทในเครือของสมาชิกในกลุ่มบริษัทดีบีเอส (ซึ่งจะเรียกรวมกันว่า "สมาชิกของดีบีเอส") มิได้รับรอง หรือรับประกันถึงความถูกต้องในเรื่องใดๆ ที่เกี่ยวข้องกับเว็บไซต์นี้ บริการทางอิเล็กทรอนิกส์ และ/หรือสารสนเทศ ข้อมูล และเนื้อหาบนเว็บไซต์นี้ รวมถึงโฆษณาต่างๆ ที่ผู้โฆษณาเป็นผู้จัดทำ ตลอดจนความน่าเชื่อถือของโฆษณานั้น

การใช้บริการส่วนตัว

ทั้งนี้ บริการ หรือเนื้อหาที่สมาชิกของกลุ่มบริษัทดีบีเอสได้จัดทำขึ้นผ่านเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ ได้ถูกจัดทำขึ้นเพื่อให้ท่านใช้เป็นการส่วนตัวเท่านั้น โดยมิได้จัดทำขึ้นเพื่อวัตถุประสงค์ในการใช้เชิงพาณิชย์ ซึ่งได้แก่ การซื้อขายเพื่อประโยชน์ทางการค้า หรือประโยชน์เชิงธุรกิจ และการค้าในลักษณะอื่นกับบุคคลอื่นในประเทศใดๆ ทั้งนี้ การบริการ สารสนเทศ ข้อมูล หรือเนื้อหาเหล่านี้มิได้จัดเตรียมเพื่อประโยชน์ของบุคคลใดบุคคลหนึ่งโดยเฉพาะ หรือบุคคลกลุ่มใดเป็นการเฉพาะเจาะจง

ความไม่รับผิด

สมาชิกของดีบีเอสไม่รับผิดชอบ และไม่ได้รับรอง หรือรับประกัน (ไม่ว่าโดยชัดแจ้ง หรือโดยปริยาย) ในความถูกต้อง ความเหมาะสม เวลา หรือความสมบูรณ์ของราคาหุ้น ตารางหุ้น ข้อความที่แสดงถึงความน่าจะเป็นในอนาคต ความเห็น การประกาศ ข้อแนะนำ การวิเคราะห์ และข้อมูลด้านการลงทุน และ/หรือข้อมูลทางการเงินในรูปแบบอื่นที่มีอยู่ในเว็บไซต์ และ/หรือบริการทางอิเล็กทรอนิกส์ ("ข้อมูลทางการเงิน") ไม่ว่าข้อมูลดังกล่าวจะจัดทำขึ้นโดยสมาชิกของดีบีเอส ผู้จัดทำเนื้อหา หรือบุคคลภายนอก ข้อมูลทางการเงินที่มีอยู่ในเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ มิได้มุ่งแสดงถึงผลการดำเนินการใดๆ ในอนาคต และมิได้มีไว้เพื่อแจกจ่ายให้กับ หรือเพื่อการใช้ของบุคคล หรือหน่วยงานในประเทศใดๆ ที่ถือว่าการแจกจ่าย หรือการใช้ข้อมูลทางการเงินดังกล่าวเป็นการขัดต่อกฎหมาย หรือระเบียบข้อบังคับของประเทศนั้นๆ ข้อมูลทางการเงินที่มีอยู่ในเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ถูกจัดทำขึ้นจากแหล่งข้อมูลที่พิจารณาแล้วว่ามีความน่าเชื่อถือ ทั้งนี้ สมาชิกของดีบีเอสไม่รับรอง หรือรับประกัน ไม่ว่าจะโดยชัดแจ้ง หรือโดยปริยาย เกี่ยวกับความแม่นยำ ความสมบูรณ์ ความเหมาะสม เวลา ของข้อมูลดังกล่าว เพื่อวัตถุประสงค์ใดเป็นการเฉพาะ ข้อมูลทางการเงินเหล่านี้เป็นข้อมูลทั่วไปเท่านั้น และมิได้ จัดทำขึ้นเพื่อใช้ในการตัดสินใจของท่าน ดังนั้น ท่านควรขอรับ คำแนะนำด้านกฎหมาย หรือด้านการเงินเป็นการต่างหากด้วย

สมาชิกของดีบีเอสไม่รับผิดชอบในรายละเอียดคำสั่งซื้อ ขายหน่วยลงทุน และ/หรือสับเปลี่ยนกองทุน ซึ่งได้มีการรับรองความถูกต้อง ตกลงยินยอมปฏิบัติและผูกพันโดยผู้ถือหน่วยลงทุนตามข้อกำหนด เงื่อนไขในการซื้อ ขาย และสับเปลี่ยนกองทุน/คำขอเปิดบัญชีกองทุนหรือแบบฟอร์มคำขอเปิดบัญชีภายใต้โครงการ FundConnext/หนังสือชี้ชวนเสนอขายหน่วยลงทุนของแต่ละกองทุนฉบับปัจจุบันและที่จะปรับปรุงแก้ไขในภายหน้าทุกประการ (ผู้ถือหน่วยลงทุนสามารถขอรับหนังสือชี้ชวนกองทุนได้ ณ ที่ทำการของบริษัทหลักทรัพย์จัดการกองทุน (บริษัทจัดการ) หรือทางเว็บไซต์บริษัทจัดการหรือผู้สนับสนุนการขายหรือรับซื้อคืนหน่วยลงทุน) ทั้งนี้ผู้ถือหน่วยลงทุนได้อ่านและเข้าใจข้อความที่ปรากฏอยู่ในคู่มือดังกล่าวแล้ว และผู้ถือหน่วยลงทุนได้ศึกษาและตกลงรับทราบดังต่อไปนี้

1. ทางสมาชิกของดีบีเอสมิได้เป็นผู้ให้คำแนะนำหรือให้คำปรึกษาด้านภาษีแต่อย่างใด
2. เงื่อนไขการถือครองหน่วยลงทุนหรือกองทุนนั้นๆ รวมถึงการจำหน่าย จ่ายโอน จำนำ หรือนำไปเป็นประกัน
3. เงื่อนไขเรื่องค่าธรรมเนียมที่เรียกเก็บ สิทธิของผู้ลงทุนตลอดจนการรับข้อร้องเรียนของผู้ลงทุนตามรายละเอียดที่บริษัทจัดการได้เผยแพร่ไว้ทางเว็บไซต์
4. เงื่อนไขและลักษณะกองทุน นโยบายกองทุน ผลตอบแทน ความเสี่ยง และผลการดำเนินงานของกองทุนก่อนตัดสินใจลงทุน ผลการดำเนินงานในอดีต/ผลการเปรียบเทียบผลการดำเนินงานที่เกี่ยวข้องกับผลิตภัณฑ์ในตลาดทุน มิได้เป็นสิ่งยืนยันถึงผลการดำเนินงานในอนาคต และความเสี่ยงดังกล่าวนั้นรวมถึง ความเสี่ยงจากอัตราแลกเปลี่ยนที่อาจเกิดขึ้นจากการลงทุนในต่างประเทศ ถึงแม้ว่ากองทุนอาจป้องกันความเสี่ยงตามดุลยพินิจของผู้จัดการกองทุนรวม แต่เนื่องจากกองทุนไม่ได้ป้องกัน ความเสี่ยงทั้งจำนวน ผู้ลงทุนอาจขาดทุนหรือได้กำไรจากอัตราแลกเปลี่ยนหรือได้รับเงินคืนต่ำกว่าการลงทุนเริ่มแรกได้
5. ยินยอมการโอนย้ายการลงทุนให้เป็นไปตามเงื่อนไขที่ระบุในหนังสือชี้ชวนหรือตามที่บริษัทจัดการเห็นสมควร เมื่อมีเหตุให้ต้องเลิกกองทุนรวมดังกล่าว
6. การลงทุนมิใช่การฝากเงินและมีความเสี่ยงในการลงทุน การได้รับเงินลงทุนคืนอาจมากกว่าหรือน้อยกว่าเงินลงทุนเริ่มแรกได้ และอาจไม่ได้รับชำระเงินค่าขายคืนหน่วยลงทุนภายในระยะเวลาที่กำหนด หรืออาจไม่สามารถขายคืนหน่วยลงทุนได้ตามที่ได้มีคำสั่งไว้ และควรซื้อขายหน่วยลงทุนกับบุคคลที่ได้รับความเห็นชอบ
7. รับทราบและยินยอมเข้าผูกพันตามรายละเอียด เงื่อนไขที่ได้รับอนุมัติจากสำนักงาน ก.ล.ต.และข้อผูกพันที่ชอบด้วยกฎหมาย รวมถึงข้อผูกพันระหว่างบริษัทจัดการและผู้ถือหน่วยลงทุนที่จัดทำขึ้นโดยชอบด้วยกฎหมายและลงนามโดยผู้ดูแลผลประโยชน์ของกองทุนรวม
8. ให้การรับรองว่าเงินลงทุนนี้มิได้เป็นเงินที่ได้มาจากแหล่งหรือกิจกรรมที่ผิดกฎหมาย ซึ่งรวมถึงแต่ไม่จำกัดเพียง กฎหมายป้องกันและปราบปรามการฟอกเงิน และกฎหมายต่อต้านการสนับสนุนการก่อการร้ายและการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง และมิได้เป็นเงินที่ได้จากการคอรัปชั่น

นอกจากนี้ สมาชิกของดีบีเอส (ซึ่งบางรายอาจถือหุ้นในดีบีเอส วิคเคอร์ส) และผู้จัดทำเนื้อหาของเว็บไซต์ และ/หรือผู้ให้บริการทางอิเล็กทรอนิกส์ อาจมีส่วนได้เสียไม่ว่าในปัจจุบัน หรือในอนาคตในบริษัทต่างๆ หรือในตราสารทางการเงินใดๆ ที่ระบุไว้ในเว็บไซต์นี้ และ/หรือในบริการทางอิเล็กทรอนิกส์ ไม่ว่ากรณีใดก็ตาม ข้อมูลทางการเงิน การบริการ สารสนเทศ ข้อมูล หรือ เนื้อหาบนเว็บไซต์นี้ไม่ถือว่าเป็นคำแนะนำ หรือการบริการด้านการลงทุน การเชิญชวน หรือข้อเสนอของสมาชิกของดีบีเอส ในการซื้อ ขาย ให้ รับ ออก จัดสรร โอน หรือดำเนินการค้าที่เกี่ยวข้องกับหุ้น พันธบัตร ตั๋วเงิน หน่วยลงทุนในทรัสต์ หน่วยลงทุนในกองทุนรวม เงินลงทุน เงินกู้ เงินจ่ายล่วงหน้า สินเชื่อ เงินฝาก หรือตราสารทางการเงินอื่นของบริษัท หรือหน่วยงานประเทศใดๆ ในปัจจุบัน หรือที่จะได้จัดตั้งขึ้นในอนาคต

การสละสิทธิ์ข้อเรียกร้อง

บริษัทหลักทรัพย์ ดีบีเอส วิคเคอร์ส (สิงค์โปร์) จำกัด และ/หรือบริษัทในเครือ และบริษัทที่เกี่ยวข้อง (อาจเรียกรวมกัน หรือแยกกันว่า "ดีบีเอสวี") ได้จัดทำรายงานที่มีข้อมูลเกี่ยวกับการประเมินราคา และ/หรือมูลค่าของหลักทรัพย์ และ/หรือข้อมูลอื่นให้กับท่านเป็นครั้งคราวในส่วนของธุรกรรมต่างๆ รวมถึงหลักทรัพย์ที่ยังคงค้างอยู่ทั้งหมดที่ท่านได้ทำธุรกรรมกับดีบีเอสวี ในการรับรายงานนี้ ท่านได้รับทราบ และยอมรับข้อกำหนด และเงื่อนไขของการจัดทำรายงานของดีบีเอสวี ดังต่อไปนี้

1. รายงานนี้ และรายงานใดๆ รวมถึงการประเมินราคา หรือมูลค่าหลักทรัพย์ และเนื้อหาอื่นๆ ทั้งหมด (รวมเรียกว่า "รายงาน") เป็นสิ่งที่จัดทำขึ้นให้แก่ท่านเพื่อใช้เป็นข้อมูลเท่านั้น และท่านต้องเก็บรักษาไว้เป็นการส่วนตัว และเป็นความลับ ท่านจะต้องไม่ใช้ข้อมูลนี้ในการอ้างอิงเพื่อวัตถุประสงค์อื่น หากรายงานนี้ได้ส่งถึงท่านโดยการส่งผ่านทางจดหมายอิเล็กทรอนิกส์ ดีบีเอสวีจะไม่รับผิดชอบต่อการฉ้อโกง หรือการแก้ไขข้อมูลใดๆ หรือความเสี่ยงใดๆ ที่เกี่ยวข้องกับการสื่อสารทางอิเล็กทรอนิกส์ในระหว่างการส่งต่อข้อมูลให้แก่ท่าน
2. รายงานนี้มิได้มีวัตถุประสงค์เพื่อที่จะบ่งชี้ หรือบอกว่า การซื้อขายหลักทรัพย์ หรือรายการชำระราคาในตลาดหลักทรัพย์นั้นมีอยู่ หรือเกิดขึ้น หรือความเหมาะสมของการใช้ข้อสันนิษฐาน (เพื่อการบัญชี หรือเพื่อวัตถุประสงค์อื่น) ที่จะสรุปว่า การซื้อขายหลักทรัพย์ดังกล่าวเกิดขึ้น และ/หรือข้อสมมุติฐานใดๆ ที่ใช้ในการประเมินราคา/มูลค่านั้นสามารถเปลี่ยนแปลงได้โดยไม่ต้องบอกกล่าวล่วงหน้า โดยราคาซื้อขายหลักทรัพย์ที่เกิดขึ้นจริง (ถ้ามี) เพื่อใช้ในการทำธุรกรรมใหม่ หรือเพื่อยกเลิก หรือโอนย้าย ธุรกรรมที่มีอยู่อาจมีการเปลี่ยนแปลงอย่างมีนัยสำคัญเมื่อเทียบกับการประเมินราคา/มูลค่าที่ดีบีเอสวีจัดทำในรายงาน เนื่องจากปัจจัยต่างๆ ซึ่งอาจหมายรวมถึงแต่ไม่จำกัดเพียงอัตราส่วนต่างของผลตอบแทนทั่วไป สภาพคล่องในตลาดของการซื้อขายหลักทรัพย์นั้นๆ ขนาดของธุรกรรม ต้นทุนทางการเงินของธุรกรรม ต้นทุนของค่าใช้จ่ายในการลดความเสี่ยง และการบริหารเงินทุน และกำไร
3. รายงานที่จัดทำขึ้นนี้อาจอยู่บนพื้นฐานของความแตกต่างในเรื่อง วัน เวลา และการประเมินราคา/มูลค่า (รวมถึงข้อมูลทางการตลาดที่นำมาใช้ในการประเมินราคา/มูลค่าดังกล่าว) ที่อาจจะเกิดขึ้นก่อนวัน และ/หรือเวลาที่นอกเหนือจากที่กล่าวไว้ในรายงานนี้ ราคาที่ใช้ในการประเมินราคา/มูลค่าของสถานะการลงทุน ของท่านอาจอยู่บนพื้นฐานของราคาปิดในตลาดตามวันที่ระบุไว้ในรายงาน หรือตามราคาปิดที่จัดหาได้จากตลาดหลักทรัพย์ที่เกี่ยวข้องสำหรับหลักทรัพย์ที่ซื้อขายในตลาดหลักทรัพย์นั้นๆ หรือเป็นราคาสุดท้ายที่ได้รับจากบริษัทที่ให้บริการด้านข้อมูลทางการเงินที่เหมาะสม หรือจากหน่วยงานที่ดูแลสภาพคล่อง (Market Maker) ให้กับหลักทรัพย์ที่ซื้อขายนอกตลาดหลักทรัพย์ (Over The Counter) หรือจากแหล่งอื่นๆ ที่ดีบีเอสวี เห็นสมควร สำหรับหุ้นกู้อนุพันธ์ และกองทุนรวมนั้น ราคาที่ใช้อาจเป็นราคาสุดท้ายที่หาได้จากผู้จัดการกองทุน หรือผู้ออกหลักทรัพย์ ดังกล่าว หรือจากแหล่งอื่นๆ ตามที่ดีบีเอสวี เห็นสมควร
4. ท่านได้ยอมรับว่า ดีบีเอสวี มิได้แนะนำท่านให้ใช้ข้อมูลนี้เพื่อกาลใดกาลหนึ่งอย่างเฉพาะเจาะจง (โดยเฉพาะข้อมูลที่ เกี่ยวกับการประเมินราคา/มูลค่า และ/หรือข้อมูลอื่นๆ ในรายงาน) รวมถึงการใช้ข้อมูลเพื่อเป็นประโยชน์ในการคำนวณด้านบัญชี และการเงินเป็นการภายใน หรือเพื่อใช้สำหรับรายงานที่มีข้อผูกพันโดยท่านควรปรึกษาผู้สอบบัญชี หรือที่ปรึกษาอื่นๆ ของท่าน ตามที่ท่านเห็นสมควร รายงานนี้จะเป็นประโยชน์ต่อท่านในส่วนของการจัดเตรียมรายงานทางการเงินของท่านหรือไม่ และโดยเฉพาะอย่างยิ่งข้อมูลเกี่ยวกับการประเมินราคา/มูลค่า และ/หรือข้อมูลอื่นในรายงานนี้ สามารถบ่งบอกถึงความเป็นไปได้ของการซื้อขายหลักทรัพย์นั้นๆ) หรือเพื่อวัตถุประสงค์อื่นใด
5. รายงานนี้ แม้ดีบีเอสวี จัดทำขึ้นโดยสุจริต ดีบีเอสวี มิได้รับประกันถึงความสมบูรณ์ หรือความถูกต้อง ความแม่นยำ หรือเป็นข้อมูลที่เกิดขึ้นที่ ณ เวลาที่นำเสนอ และท่านขอสละสิทธิ์โดยชัดแจ้งในการเรียกร้องให้ ดีบีเอสวี ต้องรับผิดชอบใดๆ สำหรับ
   1. การประมาณการ หรือข้อสมมุติฐานที่ใช้ในการประเมินราคา/มูลค่า
   2. ความผิดพลาด หรือการละเว้นในการคำนวณ หรือการเผยแพร่การประเมินราคา/มูลค่า และ
   3. การใช้ข้อมูลใดๆ ซึ่งมาจากการประเมินราคา/มูลค่า โดยดีบีเอสวี มิได้ดำเนินการแก้ไขการประเมินราคา/มูลค่าใดๆ ที่ได้ทำการจัดหาให้ หรือบอกกล่าวการแก้ไขใดๆ แก่ท่าน โดยดีบีเอสวี ไม่ขอรับผิดชอบ หรือรับประกันในความสูญเสีย หรือความเสียหายใดๆ (ไม่ว่าโดยทางตรง หรือทางอ้อม หรือผลลัพธ์ที่เกิดขึ้นภายหลัง หรือกรณีอื่น) ที่เกิดจากการใช้รายงานนี้ หรือในกรณีอื่นที่เกิดขึ้น อันมีความเกี่ยวข้องกับรายงานนี้ ภายใต้กฎหมาย หรือทฤษฎีทางกฎหมาย

6. ท่านต้องทำการตรวจสอบความสมบูรณ์ และความถูกต้องของรายงาน และทำการแจ้ง ดีบีเอสวี ภายในสิบสี่ (14) วันตามปฏิทินนับจากวันที่มีการพบข้อมูลที่ผิดพลาด หรือที่มีความแตกต่าง มิฉะนั้นจะถือว่า รายงานนี้มีความสมบูรณ์และถูกต้อง และท่านจะสละสิทธิ์ในการคัดค้านข้อมูลดังกล่าว อย่างไรก็ตาม ดีบีเอสวี สามารถแก้ไขข้อมูลในรายงานให้ถูกต้องได้ตลอดเวลา
7. ดีบีเอสวี ขอสงวนสิทธิ์ในการใช้ดุลยพินิจแต่เพียงผู้เดียว ในการปฏิเสธการจัดทำรายงานให้แก่ท่านได้ตลอดเวลา โดยไม่จำกัดว่า เป็นหลักทรัพย์ใดๆ ไม่ว่าจะมีการจัดหารายงานดังกล่าวก่อนหน้านี้มาให้แก่ท่านในลักษณะเดียวกัน หรือคล้ายคลึงกัน

คำประกาศความเป็นส่วนตัว และความลับ

รายงานนี้ ได้ถูกจัดทำขึ้นเพื่อให้แก่ผู้รับเท่านั้น หากท่านมิได้เป็นผู้รับที่มีชื่อตามที่ระบุไว้ในการส่ง ท่านจะต้องไม่ทำสำเนา หรือดำเนินการใดๆ กับรายงานนี้ หากท่านได้รับรายงานโดยความผิดพลาด โปรดกรุณาแจ้งให้ทางบริษัทฯ ทราบโดยทันที

รหัสประจำตัว

ท่านมีหน้าที่ที่จะเก็บรักษารหัสประจำตัวของท่าน (Password) ซึ่ง ดีบีเอส วิคเคอร์ส ได้มอบให้โดยเก็บรักษาไว้เป็นความลับ และท่านตกลงที่จะไม่เผยแพร่รหัสประจำตัวดังกล่าวให้แก่บุคคลใดทราบ หากท่านได้มอบรหัสผ่านให้บุคคลใดใช้ ท่านตกลงที่จะเป็นผู้รับผิดชอบ ต่อการใช้รหัสประจำตัวของบุคคลดังกล่าว ที่มีต่อ ดีบีเอส วิคเคอร์ส ทุกประการ และตกลงยอมรับว่า การกระทำใดที่เป็นผลมาจากการเข้าใช้เว็บไซต์โดยใช้รหัสประจำตัวของท่านเป็นการกระทำการของท่านทุกประการ อนึ่ง ภายใต้บังคับของกฎหมายที่เกี่ยวข้อง ดีบีเอส วิคเคอร์ส ไม่มีความรับผิดชอบใดๆ ต่อการใช้รหัสประจำตัว โดยบุคคลที่ไม่ได้รับอำนาจ และ/หรือมิชอบ และไม่ได้รับอนุญาตจากท่าน ในการนี้ "รหัสประจำตัว" หมายความถึง รหัส หรือหมายเลขประจำตัวส่วนบุคคลที่กำหนดให้ใช้ในการใช้บริการเข้าเว็บไซต์นี้ ที่ได้รับจาก ดีบีเอส วิคเคอร์ส

การทำสัญญาแยกต่างหาก

สินค้า หรือบริการอื่น (ถ้ามี) ของกลุ่มบริษัทดีบีเอส ผ่านบริการทางอิเล็กทรอนิกส์ตามสัญญาที่จะจัดทำแยกต่างหาก จะอยู่ภายใต้การรับประกัน (ในกรณีที่มีการรับประกัน) ตามข้อกำหนดที่ระบุไว้อย่างชัดแจ้งของสัญญาดังกล่าวเท่านั้น และสมาชิกของดีบีเอส ไม่รับรอง หรือรับประกันในสินค้า หรือบริการดังกล่าว ในกรณีที่ท่านเป็นลูกค้าของดีบีเอส วิคเคอร์ส ข้อตกลง และเงื่อนไขในสัญญาเปิดบัญชีซื้อขายหลักทรัพย์ประเภทเงินสด (DBS Vickers Securities Trading Cash Account Agreement) จะบังคับกับการเข้า และใช้เว็บไซต์นี้ของท่านด้วย ในกรณีมีความขัดแย้งกันระหว่างข้อกำหนด และเงื่อนไขในสัญญาเปิดบัญชีซื้อขายหลักทรัพย์ประเภทเงินสด และข้อกำหนด และเงื่อนไขการเข้า และใช้เว็บไซต์นี้ ให้ถือตามข้อกำหนด หรือเงื่อนไขในสัญญาเปิดบัญชีซื้อขายหลักทรัพย์ประเภทเงินสด

ทรัพย์สินทางปัญญา

กลุ่มบริษัทดีบีเอส เป็นผู้มีสิทธิแต่เพียงผู้เดียวในทรัพย์สินทางปัญญาในการบริการ ซอฟท์แวร์ สารสนเทศ ข้อมูล และเนื้อหาที่จัดทำขึ้นในเว็บไซต์นี้ และ/หรือในบริการทางอิเล็กทรอนิกส์ รวมถึงสิทธิในลิขสิทธิ์ เครื่องหมายการค้า และเครื่องหมายบริการ บรรดาข้อความเนื้อหา โปรแกรมทางคอมพิวเตอร์ รูปภาพ วีดีโอ เสียง หรือภาพกราฟฟิค ทั้งหลายที่นำมาแสดงบนเว็บไซต์ย่อมได้รับความคุ้มครองในลิขสิทธิ์ เครื่องหมายการค้า สนธิสัญญาระหว่างประเทศ และ/หรือสิทธิในความเป็นเจ้าของอื่นๆ และตามกฎหมายของประเทศไทย และของประเทศอื่น ทั้งนี้ เครื่องหมายการค้า เครื่องหมายบริการ และตราสัญลักษณ์ทั้งหมดที่ใช้ในเว็บไซต์นี้ เป็นทรัพย์สินของกลุ่มบริษัทดีบีเอส และ/หรือ บุคคลภายนอกที่เป็นเจ้าของเครื่องหมาย หรือตราสัญลักษณ์ดังกล่าวตามที่ระบุไว้ในเว็บไซต์นี้ ท่านไม่ได้รับอนุญาตในการทำซ้ำ แจกจ่าย ตีพิมพ์ ถ่ายโอน ติดประกาศ ส่งผ่าน หรือเชื่อมโยงเนื้อหาข้อมูลในเว็บไซต์นี้ และ/หรือในบริการทางอิเล็กทรอนิกส์ รวมถึงข้อความ รูปภาพ รหัส และ/หรือซอฟท์แวร์ในลักษณะ หรือรูปแบบใดๆ โดยไม่ได้รับความเห็นชอบเป็นลายลักษณ์อักษรล่วงหน้าอย่างชัดแจ้งจากสมาชิกของกลุ่มบริษัทดีบีเอส และผู้เป็นเจ้าของลิขสิทธิ์ เครื่องหมายการค้า และเครื่องหมายบริการที่เกี่ยวข้อง นอกจากนี้ ท่านไม่ได้รับอนุญาต ในการทำการเชื่อมโยง (hyperlinks) เพื่อการเข้าสู่เว็บไซต์นี้ โดยเชื่อมโยงไปยังเว็บไซต์อื่น หรือ "คัดลอก" เนื้อหาข้อมูลที่ปรากฏบนเว็บไซต์นี้ไปยังฐานบริการ (server) อื่น โดยไม่ได้รับอนุญาตจากกลุ่มบริษัทดีบีเอส เครื่องหมายทางการค้าต่างๆ ชื่อทางการค้า เครื่องหมายการให้บริการ ชื่อสินค้า และเครื่องหมายอื่นๆ ทั้งหมด ซึ่งปรากฏบนเว็บไซต์นี้ย่อมใช้เพื่อประโยชน์ของเจ้าของ และผู้ได้รับอนุญาตให้ใช้เครื่องหมายต่างๆ นั้น เท่านั้น และไม่มีความตั้งใจเพื่อกระทำการใดอันเป็นการละเมิดสิทธิในเครื่องหมายการค้า และ/หรือสิทธิอื่นใด

การแยกความรับผิด และการชดใช้ความเสียหาย

ไม่ว่าในกรณีใดก็ตาม สมาชิกของดีบีเอส ไม่ต้องรับผิดต่อบุคคลใดๆ สำหรับค่าเสียหาย ค่าเรียกร้อง ค่าใช้จ่าย หรือการสูญเสียที่เกิดขึ้นจาก หรือเกี่ยวข้องกับ (ก) การเข้าใช้ การใช้ หรือการไม่สามารถเข้าใช้ หรือใช้เว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ (ข) การใช้ หรือความเชื่อถือในความแม่นยำ การมีอยู่ เงินตรา ชื่อ การไม่ละเมิดสิทธิ คุณภาพ ความน่าเชื่อถือ ความสามารถในการซื้อขายความเหมาะสมสำหรับวัตถุประสงค์ใดโดยเฉพาะ ความเหมาะสม และความสมบูรณ์ของบริการ สารสนเทศ ความปลอดภัย ข้อมูล และเนื้อหา หรือ (ค) ระบบฐานบริการ (server) หรือความไม่สามารถในการเชื่อมต่อระบบ ความผิดพลาด การละเว้นกระทำการ การสอดแทรก ความล่าช้าในการส่งถ่ายข้อมูล ไวรัสคอมพิวเตอร์ รหัส เอเจนท์โปรแกรม (agent program) หรือแมคโคร (macros) ที่เป็นอันตราย หรือสามารถทำลาย หรือเป็นภัยต่อระบบ โดยไม่คำนึงถึงว่า สมาชิกของดีบีเอส ได้รับทราบถึงโอกาส หรือความเป็นไปได้ของการเกิดความเสียหาย ค่าเรียกร้อง ค่าใช้จ่าย หรือการสูญเสียเหล่านั้นแล้วก็ตาม ในการที่ท่าน ได้เข้าสู่เว็บไซต์นี้แล้ว ท่านตกลงที่จะชดใช้ค่าเสียหายต่อสมาชิกของดีบีเอส สำหรับค่าเสียหาย การสูญเสีย ค่าใช้จ่าย และค่าดำเนินการ (รวมถึงค่าดำเนินการทางกฎหมาย) ที่สมาชิกของดีบีเอส ได้รับ หรือที่อาจจะเกิดขึ้น ซึ่งสืบเนื่องมาจากการที่ท่านเข้าใช้เว็บไซต์นี้ และ/หรือการใช้บริการทางอิเล็กทรอนิกส์ และ/หรือสารสนเทศ ข้อมูล และเนื้อหาที่มีอยู่บนเว็บไซต์ และ/หรือบริการทางอิเล็กทรอนิกส์ นอกจากนี้ สมาชิกของดีบีเอส ไม่ต้องรับผิดต่อความเสียหายใดๆ ที่เกิดขึ้นเนื่องจากเหตุที่อยู่นอกเหนือการควบคุมของสมาชิกของดีบีเอส ซึ่งรวมถึงแต่ไม่จำกัดเพียงการขัดข้องของอุปกรณ์ทางอิเล็กทรอนิกส์ หรือทางเครื่องกล หรืออุปกรณ์เพื่อการติดต่อสื่อสาร โทรศัพท์ หรือการขัดข้องด้านการติดต่อเชื่อมโยงอื่นๆ การเข้าเว็บไซต์โดยบุคคลที่ไม่มีอำนาจ การขัดข้องของการคมนาคมสาธารณะ การติดต่อสื่อสารผ่านตัวกลางทั่วไป หรือระบบจัดการข้อมูล หรือการขโมย (รวมถึงการขโมยรหัสผ่าน รหัส หรือข้อมูลเพื่อการเข้าสู่ระบบ) และความผิดพลาดของตัวประมวลผล

การเชื่อมโยงกับเว็บไซต์อื่น (Hyperlinks)

เว็บไซต์นี้ มีการเชื่อมโยงกับเว็บไซต์อื่นๆ ที่จัดทำขึ้นโดยบุคคลภายนอก และเป็นเจ้าของเว็บไซต์นั้น โปรดทราบว่า การเชื่อมโยงดังกล่าวนี้มีขึ้นเพื่อให้ความสะดวกแก่ท่านเท่านั้น เว็บไซต์ที่เชื่อมโยงนี้มิได้อยู่ภายใต้การควบคุม หรือดูแลโดยดีบีเอส วิคเคอร์ส ทั้งนี้ ดีบีเอส วิคเคอร์ส ไม่ได้ตรวจทาน อนุมัติ และไม่รับผิดชอบในเนื้อหา หรือข้อมูลใดๆ ของเว็บไซต์ที่เชื่อมโยง หรือเว็บไซต์ใดๆ ที่ปรากฏในเว็บไซต์ ที่เชื่อมโยงนี้ หรือการเปลี่ยนแปลง หรือการปรับข้อมูลให้ทันสมัยในเว็บไซต์นี้ และรวมถึงความถูกต้อง คุณภาพ การเกิดขึ้นในเวลาที่เหมาะสมของเนื้อหา เว็บไซต์ที่เชื่อมโยงนี้มิได้แสดงว่า ได้รับการสนับสนุนจากดีบีเอส วิคเคอร์ส และ ดีบีเอส วิคเคอร์ส ไม่ขอรับผิดชอบในความสูญหาย หรือเสียหายใดๆ ที่เกิดขึ้นแก่ผู้ใช้เว็บไซต์ หรือความเสียหายใดๆ ที่ท่านได้รับ หรือความเสียหายใดๆ ที่เกิดขึ้นจากบุคคลภายนอก หรือที่บุคคลภายนอกได้รับ ไม่ว่าจะเกิดขึ้นจากการเชื่อมโยงเว็บไซต์นี้หรือไม่ก็ตาม ทั้งนี้ ท่านตกลงว่า การที่ท่านเข้าสู่ หรือใช้เว็บไซต์ที่เชื่อมโยงเข้าไปดังกล่าว เป็นความเสี่ยงของท่าน แต่เพียงผู้เดียว และท่านตกลงที่จะอยู่ภายใต้บังคับของข้อกำหนด และเงื่อนไขของการเข้า หรือการใช้ที่ระบุไว้ในเว็บไซต์นั้นๆ

การเปิดเผยข้อมูลแก่บุคคลที่สาม

ทั้งนี้ ในส่วนของกองทุน กลุ่มบริษัทดีบีเอสได้รับข้อมูลจากบริษัทจัดการและผู้เกี่ยวข้อง (ซึ่งรวมถึง กองทุน เจ้าของผลิตภัณฑ์ทางการเงินที่บริษัทจัดการ/กองทุนใช้บริการหรือเข้าเป็นคู่สัญญาเพื่อประโยชน์ในการบริหารกองทุน และผู้สนับสนุนการขาย/ตัวแทนของบริษัทจัดการและของบุคคลดังกล่าว) โดยผู้ถือหน่วยลงทุนตกลงและยินยอมให้บริษัทเปิดเผยข้อมูลเกี่ยวกับบัญชีการลงทุนแก่บุคคลที่สามและผู้เกี่ยวข้อง รวมถึงดำเนินการอื่นใด (รวมถึงการปิดบัญชีการลงทุน การหัก ณ ที่จ่าย--ถ้ามี) เกี่ยวกับบัญชีกองทุนของผู้ถือหน่วยลงทุน เพื่อให้บริษัทจัดการและผู้ที่เกี่ยวข้องรวมถึงผู้ที่ได้รับการเปิดเผยข้อมูลดังกล่าว สามารถใช้ข้อมูลและปฏิบัติให้เป็นไปตามข้อกำหนดของกฎหมาย หรือข้อกำหนดของหน่วยงานราชการทั้งในและต่างประเทศรวมถึงกฎเกณฑ์ภายในของตน นอกจากนี้ข้าพเจ้าตกลงที่จะนำส่งข้อมูลและเอกสารเพิ่มเติมตามที่บริษัทจัดการร้องขอ

ความลับ

ข้อมูลที่ลงทะเบียน หรือข้อมูลอื่นใดของท่าน และ/หรือผู้ใช้เว็บไซต์อื่นอยู่ภายใต้นโยบายความลับของกลุ่มดีบีเอส

ข้อมูลทั่วไป

กลุ่มบริษัทดีบีเอสมีสิทธิแต่เพียงผู้เดียวในการเปลี่ยนแปลง และแก้ไขเว็บไซต์ หรือส่วนใดส่วนหนึ่งของเว็บไซต์ บริการทางอิเล็กทรอนิกส์ ข้อมูลทางการเงิน รวมถึงการแก้ไขเปลี่ยนแปลงสัญญาฉบับนี้ ณ เวลาใดๆ โดยไม่ต้องคำนึงถึงข้อกำหนด และเงื่อนไขที่ระบุไว้ข้างต้น และไม่ต้องแจ้งให้ท่านทราบล่วงหน้าด้วย นอกจากนี้ กลุ่มบริษัทดีบีเอสยังสามารถปรับปรุง ระงับ หยุด หรือถอดถอนยกเลิกส่วนใดส่วนหนึ่ง หรือทั้งหมดของเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์เป็นครั้งคราวไป โดยไม่ต้องให้เหตุผล หรือแจ้งให้ท่านทราบล่วงหน้า และกลุ่มบริษัทดีบีเอส ไม่ต้องรับผิดใดๆ ในกรณีที่การปรับปรุง แก้ไข ระงับ หรือการเปลี่ยนแปลงเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ เป็นเหตุให้ท่านไม่สามารถเข้าสู่เว็บไซต์นี้ หรือส่วนใดๆ ของเว็บไซต์ และ/หรือใช้บริการทางอิเล็กทรอนิกส์ หรือส่วนใดๆ ของบริการทางอิเล็กทรอนิกส์

ข้อมูลการวิจัยโดยดีบีเอส วิคเคอร์ส

ข้อมูลทางการเงินที่ปรากฏบนเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์บางส่วนได้ถูกจัดทำขึ้น โดยสมาชิกของดีบีเอส ทั้งนี้ สมาชิกของดีบีเอส และหุ้นส่วนอื่น ๆ ไม่ต้องรับผิดต่อความเสียหายที่เกิดขึ้นในกรณีใดๆ หรือผลต่อเนื่อง หรือการสูญเสีย หรือค่าเสียหายอื่นใดที่เกิดจากการใช้ข้อมูลทางการเงิน (รวมถึงข้อผิดพลาด การละเว้นกระทำการ หรือการแสดงข้อความที่ผิดไปจากความเป็นจริงในเว็บไซต์นี้ ความประมาทเลินเล่อ ไม่ว่าความเสียหายนั้นจะเกิดจากการผิดสัญญา ละเมิด รวมถึงความเสียหายต่าง ๆ ค่าใช้จ่าย ค่าดำเนินคดีในศาล ค่าขึ้นศาล ค่าทนายความที่สมเหตุสมผล และค่าใช้จ่ายเกี่ยวกับวิชาชีพ) ค่าปรับ จำนวนเงินค่าเสียหายที่มีการตกลงกับบุคคลใดบุคคลหนึ่ง ทรัพย์สินต่าง ๆ ที่เสียหายไม่ว่าทั้งหมด หรือแต่บางส่วน หรือกรณีอื่น) หรือการติดต่อสื่อสารที่เกิดขึ้น ในภายหลังเกี่ยวกับข้อมูลดังกล่าว โดยไม่คำนึงว่า สมาชิกของดีบีเอส จะได้รับทราบถึงโอกาส หรือความเป็นไปได้ที่ความเสียหาย ค่าเรียกร้อง ค่าใช้จ่าย หรือการสูญเสียเหล่านั้นจะเกิดขึ้นแล้วหรือไม่ก็ตาม ข้อมูลทางการเงินที่สมาชิกของดีบีเอส จัดทำขึ้นไม่ได้ทำขึ้นเพื่อแจกจ่ายให้กับ หรือเพื่อการใช้ของบุคคล หรือหน่วยงานในประเทศที่การแจกจ่าย หรือการใช้ข้อมูลทางการเงินดังกล่าวมีผลเป็นการขัดต่อกฎหมาย หรือระเบียบข้อบังคับของประเทศนั้นๆ ข้อมูลทางการเงินที่มีอยู่ในเว็บไซต์นี้ และ/หรือบริการทางอิเล็กทรอนิกส์ถูกจัดทำขึ้นมาจากแหล่งข้อมูลที่พิจารณาแล้วว่ามีความน่าเชื่อถือ แต่ทั้งนี้สมาชิกของดีบีเอส ไม่รับรอง หรือรับประกันถึงความแม่นยำ ความสมบูรณ์ ความเหมาะสม เวลา หรือความถูกต้องของข้อมูลดังกล่าว เพื่อวัตถุประสงค์ใดเป็นการเฉพาะ ข้อมูลทางการเงิน เหล่านี้จัดทำขึ้นเพื่อเป็นข้อมูลทั่วไปเท่านั้น และมิได้ทำขึ้นเพื่อใช้ในการตัดสินใจของท่าน และท่านควรขอรับ คำแนะนำด้านกฎหมาย หรือด้านการเงินเป็นการต่างหากด้วย ความเห็นที่สมาชิกของดีบีเอส แสดงไว้สามารถเปลี่ยนแปลงได้ โดยไม่ต้องแจ้งให้ท่านทราบ รวมถึงข้อแนะนำในข้อมูลทางการเงินที่สมาชิกดีบีเอส จัดทำขึ้นมิได้มีเพื่อวัตถุประสงค์ด้านการลงทุน สถานการณ์ทางการเงิน และเพื่อตอบสนองความต้องการของผู้รับข้อมูลคนใดคนหนึ่ง โดยเฉพาะ ทั้งนี้ สมาชิกของดีบีเอส และบริษัทร่วม รวมถึงกรรมการ เจ้าหน้าที่ และ/หรือพนักงานของสมาชิกดีบีเอส อาจดำรงตำแหน่ง หรือมีส่วนได้เสีย และอาจทำเข้าทำรายการเกี่ยวกับการซื้อขายหลักทรัพย์ที่ระบุไว้ในข้อมูล ทางการเงินได้ รวมถึงอาจดำเนินการในลักษณะเป็นตัวแทนนายหน้า ที่ปรึกษาด้านการลงทุน และการบริการทางธนาคาร หรือการบริการทางการเงินสำหรับบริษัทเหล่านั้นได้

ท่านผู้ใช้ข้อมูลยังคงต้องรับผิดชอบต่อบริษัท รวมถึง กรรมการ พนักงาน เจ้าหน้าที่ ลูกจ้าง ตัวแทน ที่ปรึกษา บริษัทลูก บริษัทร่วม บริษัทแม่ และหุ้นส่วนอื่น ๆ ในความเสียหายต่าง ๆ ที่เกิดขึ้นจากการกระทำ ละเว้นกระทำการของท่านผู้ใช้ข้อมูล ไม่ว่าความเสียหายนั้นจะเกิดจากการผิดสัญญา ละเมิด รวมถึงความเสียหายต่าง ๆ ค่าใช้จ่าย ค่าดำเนินคดีในศาล (รวมถึง ค่าขึ้นศาล ค่าทนายความที่สมเหตุสมผล และค่าใช้จ่ายเกี่ยวกับวิชาชีพ) ค่าปรับ จำนวนเงินค่าเสียหายที่มีการตกลงกับบุคคลใดบุคคลหนึ่ง ทรัพย์สินต่าง ๆ ที่เสียหายไม่ว่าทั้งหมด หรือแต่บางส่วนจากการที่ได้จัดการข้อมูลนี้ให้แก่ท่าน

การเปิดเผยทั่วไป / คำประกาศยกเว้นความรับผิด

เอกสารฉบับนี้ตีพิมพ์โดย บริษัทหลักทรัพย์ ดีบีเอส วิคเคอร์ส (ประเทศไทย) จำกัด ("ดีบีเอสวีที") ซึ่งเป็นบริษัทลูกที่ถือหุ้นทั้งหมดโดยตรง โดยดีบีเอส วิคเคอร์ส ซีเคียวริตี้ส์ โฮลดิงส์ ไพรเวต ลิมิเต็ด ("ดีบีเอสวีเอช") [รายงานฉบับนี้มีวัตถุประสงค์เพื่อให้ลูกค้าของดีบีเอสวี กรุ๊ป ทราบเท่านั้น และห้ามมิให้ (1) ทำสำเนา ถ่ายสำเนา หรือทำซ้ำเอกสารฉบับนี้ไม่ว่าส่วนหนึ่งส่วนใด และไม่ว่าในรูปแบบ หรือโดยวิธีการอื่นใดก็ตาม หรือ (2) แจกจ่ายต่อโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรของดีบีเอสวีทีก่อน]

   2. ดีบีเอสวียูเอสเอ ไม่มีหน่วยงานด้านวาณิชธนกิจ หรือหน่วยงานวิจัย และมิได้เข้าไปมีส่วนร่วมในธุรกรรมทางด้านวาณิชธนกิจทั้งในฐานะผู้จัดการ หรือผู้จัดการร่วมในช่วงระยะเวลา 12 เดือนที่ผ่านมา บุคคลสัญชาติอเมริกันคนใดที่ประสงค์จะได้รับข้อมูลต่างๆ รวมถึงคำประกาศการรับรองการเปิดเผยข้อมูลนี้ หรือผลกระทบใดๆ ต่อธุรกรรมใน หลักทรัพย์ต่างๆ ที่มีอยู่ในเอกสารนี้ขอให้ติดต่อกับ ดีบีเอสวียูเอสเอ เป็นการเฉพาะ
